3. Scope and the contract
3.1. These Terms apply to every contract between us and a guest, whether made on the website, by email, by phone or at the studio. The contract is governed by Hungarian law, in particular Act V of 2013 on the Civil Code, Government Decree 45/2014 (II. 26.) on contracts between consumers and businesses, Act CVIII of 2001 on electronic commerce and Act CLV of 1997 on consumer protection. If you are a consumer living in another EU country, this does not deprive you of the protection of the mandatory rules of your country.
3.2. A contract made on the website is a distance contract. It is not a written contract and we do not file it; its details are kept in the confirmation email and in your account, both of which remain available after the contract is made.
3.3. The language of the contract is the language (Hungarian or English) in which you use the website. The Hungarian and English versions of these Terms have the same content; if they differ, the interpretation more favourable to the consumer applies.
3.4. We have not signed up to any code of conduct.
4. Services and prices
4.1. At the studio we offer group classes (mainly yoga), one-to-one treatments (massage, ayurveda, physiotherapy, henna), and passes, a membership and gift cards for these. The current timetable, treatments, passes and prices are shown on the website.
4.2. Prices are in Hungarian forints (HUF). We are exempt from VAT (small business exemption), so prices include no VAT, and no other charge (such as a booking fee) is added.
4.3. We may change our prices at any time; changes do not affect contracts already made (for example passes already bought or treatments already booked). We will email members about any change to the membership fee at least 30 days before the next charge; a member may then end the membership free of charge before the change takes effect, regardless of the minimum term in 9.4.
4.4. If an obviously wrong price appears on the website (for example 0 HUF or a fraction of the usual price), we are not obliged to provide the service at that price. We will offer the correct price; if you do not accept it, we refund anything you have paid without delay.
5. Guest account
5.1. You need an account to book and buy online. The account is free; there is no password: you sign in with a single-use link sent to your email address. The account is created when you first sign in; at your first booking we ask for your name and, optionally, your phone number.
5.2. You are responsible for giving accurate details and for keeping your email account to yourself. If you think someone else has access to your account, you can end every session with "sign out on all devices" in your account, and please let us know.
5.3. In your account you can see and manage your bookings, passes, treatment appointments and payments, and change your name, phone number, email language and newsletter subscription. You can ask us by email to delete your account.
6. Booking a class
6.1. How booking works:
- Choose a class on the timetable.
- Sign in (or use the link sent to your email address).
- Choose to book with a valid pass, a single ticket, or a new pass.
- For a single ticket or a new pass, pay on Stripe's payment page (see section 10), where you see the total before you pay and can enter one coupon or gift card.
- The booking is made when you press the booking button or, if you pay, when the payment succeeds; we then send you a confirmation email.
Until you confirm the booking or pay, you can go back and change your choices at any time; on Stripe's page you can leave without paying using "back". If the confirmation does not arrive within 48 hours (please check your spam folder too), let us know.
6.2. When you book with a pass, one class is deducted from it straight away. One booking deducts one class.
6.3. While you pay online for a single ticket, your place is held for up to 30 minutes; if you have not paid by then, or you cancel on the payment page, the place is released.
6.4. Online booking is possible until the class starts, or until any earlier deadline shown on the website. Classes have a limited number of places; a full class is marked "Full".
6.5. Waitlist. You can join the waitlist for a full class. When a place frees up, we email everyone on the waitlist at the same time, and the place goes to whoever books it first. Joining the waitlist is not a booking and deducts nothing.
6.6. We may replace a class's instructor for good reason (for example illness); we email everyone booked on the class. The identity of the instructor is not an essential term of the contract.
7. Cancelling a class
7.1. Cancelling yourself. You can cancel a booking in your account free of charge at least 12 hours before the class starts (the deadline shown on the website at the time applies). Then:
- for a class booked with a pass, the class goes back onto your pass;
- for a single ticket paid online, the full amount is refunded automatically to the same payment method, and any part paid by gift card goes back onto the gift card;
- for a single ticket to be paid at the studio, you owe nothing.
7.2. If you cancel later, or do not come, the class counts as used: the ticket price is not refunded, and a ticket to be paid at the studio is still due. In justified cases (for example a documented illness) the studio's management may, at its discretion, return the class or the ticket price; you have no automatic right to this.
7.3. If we cancel or move a class. If we cancel a class, or it does not take place, every booking is cancelled: pass classes are returned, single tickets paid online are refunded automatically, and we email everyone booked. If the time of a class changes, we email everyone booked; if the new time does not suit you, tell us before the class starts and we will return the class or the ticket price, regardless of the cancellation deadline.
7.4. Beyond the above we pay no compensation or penalty for a class that does not take place, unless the law requires it.
8. Treatments (massage, ayurveda, physiotherapy, henna)
8.1. Requesting a time. On the website you choose the treatment, its length, the massage therapist, physiotherapist or henna artist (or "anyone available") and a free time. Treatments can be requested at least 3 hours and at most 28 days ahead (the limits shown on the website apply).
8.2. Confirmation. Sending a request is your offer; we hold the time for you until it is confirmed. The contract is made when the person giving the treatment confirms the request and we email you. Before confirming, they may propose another time within their working hours; the treatment is then booked for the new time, we email you, and you can cancel it free of charge until it starts. If you chose "anyone available", another free colleague may take over the request, and we email you about it.
8.3. If nobody confirms the request within 24 hours, or before the requested time begins (whichever comes first), the request expires, the time is released and we email you. An expired request costs you nothing.
8.4. Payment. Until the website offers online payment for treatments, they are paid at the studio on the day of the treatment, at the price shown on the website when you requested it.
8.5. Cancelling. A confirmed treatment, also one we have moved to another time, can be cancelled in your account free of charge at least 24 hours before it starts; a request still waiting for confirmation, until it starts. If you cancel within 24 hours or do not come, the price of the treatment is due, and we can book you a new time once the missed treatment has been paid for. In justified cases (for example sudden illness) the studio manager may decide to waive the payment; this is not a right you can claim. If you find out within 24 hours that you cannot come, please call us, so that another guest can have the time.
8.6. If the massage therapist, physiotherapist or henna artist cannot give the treatment, we tell you without delay and offer another time; you may then withdraw free of charge.
9. Passes and membership
9.1. The kinds of pass, the number of classes, the validity period and the price are shown on the website's Passes page and when you buy. A pass is valid from the moment it is paid for (or issued at the studio); a class must start within the pass's validity period.
9.2. A pass is personal and cannot be transferred to anyone else. One booking deducts one class.
9.3. Classes not used by the end of the validity period are lost and are not refunded. In justified cases (for example a longer illness) the studio's management may extend a pass on request. Some passes (for example the intro pass) can be bought only once per guest; the website says so at the pass.
9.4. Monthly membership. The membership is a monthly renewing pass for unlimited classes during its validity, bought online as a card subscription. Stripe charges the fee to your card automatically every month, on the day matching your first purchase, and each paid month creates a new membership pass valid for one month.
- The membership is made for the minimum term shown on the website when you buy (currently 3 months); you cannot end it during that term, except under the right of withdrawal in section 12, under 4.3 and when leaving because of illness (below).
- After the last payment of the minimum term the membership ends by itself and nothing more is charged. To continue, you can buy a new membership.
- If you fall ill, you can leave the membership before the minimum term ends. Ask us for this (by email or at the studio); we stop the membership for you. Nothing more is charged after that, the membership pass of the month already paid can be used until it expires, and fees already paid are not refunded.
- You can change your card in Stripe's customer portal, reachable from your account.
- If a monthly charge fails, Stripe tries again within a few days and you receive an email; no membership pass is created for a month until it is paid.
- The membership cannot be paid with a coupon or gift card.
9.5. The price of passes and of the membership is not refundable, except on withdrawal under section 12 and for classes we cancel.
10. Payment
10.1. Online payment. Online payments are made on the secure payment page of Stripe Payments Europe, Limited (Ireland), by card, Apple Pay or Google Pay, in HUF. We never see or store your card details. Stripe tells us the result; the booking or pass becomes final once the payment is confirmed.
10.2. Paying at the studio. Passes bought at the studio, single tickets to be paid at the studio and treatments are paid at the studio, by the payment methods available there. The website shows when booking whether a class can be booked online with a ticket to be paid at the studio.
10.3. Refunds. When money is owed to you (for example after a cancellation within the deadline, or for a class that did not take place), we refund it to the payment method you used; any part paid by gift card goes back onto the gift card. We start the refund without delay; how long it takes to appear depends on your card issuer (usually 5–10 working days).
10.4. Invoice. We issue an electronic invoice for your purchase and send it by email. The invoice is made out with the billing details you give before your first online booking or payment (you can change them in your account); you are responsible for their being correct. By accepting these Terms you agree to receiving electronic invoices.
11. Gift cards and coupons
11.1. Gift cards. When signed in, you can buy a gift card on the website, for one of the amounts offered or any amount within the limits shown, with the recipient's name and, if you wish, their email address and a message. We email the gift card to the recipient or to you. Gift cards can also be bought at the studio.
11.2. A gift card is valid for 6 months from purchase (the expiry date on the card applies). Until then its balance can be spent, in one go or in parts, on single tickets and passes on the website and on any service at the studio. It cannot be used for the membership. If the gift card does not cover the whole price, you can pay the rest by card.
11.3. A gift card cannot be exchanged for cash, and any balance left at expiry is lost. Anyone with the code can check the balance on the website; please keep the code safe, since whoever knows it can spend it. In justified cases we may extend an expired gift card.
11.4. If money is owed back on a purchase paid partly by gift card, the gift card part goes back onto the gift card and the rest to your card.
11.5. Coupons. Each coupon's conditions (discount, validity, what it applies to, usage limits) are set when it is issued. One coupon can be used per payment, and you see the discount before you pay. Coupons cannot be used for the membership or exchanged for cash. If a payment is fully refunded, the coupon use is restored.
12. Right of withdrawal
12.1. Services for a specific date and time. Consumers have no right of withdrawal from contracts for leisure services to be provided on a specific date or at a specific time (Government Decree 45/2014, section 29(1)(l)). This covers single tickets for a given class and booked treatments. You can cancel these free of charge within the deadlines in sections 7 and 8.
12.2. Passes, membership and gift cards. For a pass, membership or gift card bought on the website, a consumer may withdraw from or terminate the contract within 14 days of making it, without giving a reason.
- If you have not used the pass or membership yet, we refund the full price.
- If you booked a class with the pass or membership within the 14 days, you thereby expressly asked us to start providing the service. If you then terminate, you pay a proportionate amount for what you used up to your notice: for a pass, its price divided by its number of classes for each class used (not cancelled); for the membership, the monthly fee in proportion to the days that have passed (Government Decree 45/2014, section 23). We refund the difference.
- For a gift card, we refund the unused balance.
12.3. The right of withdrawal does not apply to contracts made in person at the studio.
12.4. How to withdraw. Tell us clearly that you wish to withdraw or terminate, by email (connection@sanctuary.hu) or by post; you may use the model form at the end of these Terms. To meet the deadline it is enough to send your statement before the 14 days are over. As you must be able to prove you withdrew, we recommend email.
12.5. Refund. We refund the amount due within 14 days of receiving your statement, using the payment method you used, at no extra cost to you. With your express agreement we may use another method.
13. Taking part, health, house rules
13.1. You take part in classes and treatments at your own responsibility, in the knowledge of your own health. If you have any illness, injury or recent surgery, are pregnant, or are unsure for any other reason whether you can take part, please consult your doctor first and tell the instructor, massage therapist, physiotherapist or henna artist before the class or treatment.
13.2. Classes and treatments are not healthcare services and do not replace a medical examination or treatment. We work with professional care, but we promise no particular health outcome.
13.3. Arriving late. We lock the studio door when the class starts: out of respect for the others' practice, a class cannot be started late or joined after it has begun; the class then counts as used. Please arrive a few minutes before the start. If you arrive late for a treatment, it still ends at the booked time and the price is not reduced.
13.4. Please use the studio's equipment properly, follow the instructions of the instructors, massage therapists, physiotherapists and henna artists, and respect the peace of other guests. We may exclude a guest who seriously or repeatedly breaks the house rules from a class or treatment and refuse further contracts with them.
13.5. Please do not leave valuables unattended. We are liable for items left at the studio only as the law provides.
14. Liability and the website
14.1. We do our best to keep the website running, but we are not liable for faults caused by the internet, the payment provider or anything else outside our control. If a booking fails because of a technical error, or you are unsure whether it went through, please contact us by email or phone.
14.2. Except for damage caused intentionally or by gross negligence, and damage to life, physical integrity or health, our liability is limited, to the extent the law allows, to the price of the service concerned (Civil Code, section 6:152).
14.3. If a service is not performed as agreed, consumers have the rights under sections 6:159 et seq. of the Civil Code: primarily to have the service repeated or, where that is impossible or unreasonable, a proportionate price reduction, and in case of a serious defect to withdraw from the contract. Please tell us about any defect as soon as you notice it.
14.4. The website's content (texts, photos, logo, design) is protected by copyright belonging to us or to the rights holders, and may not be copied or used without permission (Hungarian Act LXXVI of 1999).
15. Complaints and remedies
15.1. You can complain orally (at the studio or by phone) or in writing (by email or post) using the contact details in section 1. We look into an oral complaint at once and put it right if we can; if we cannot, or you disagree with how it was handled, we record it in writing and give or send you a copy. We answer written complaints in writing, on the merits, within 30 days of receipt, and give reasons for any rejection. We keep complaints and our answers for 3 years.
15.2. If we reject your complaint, as a consumer you can turn to:
The consumer protection authority: the government office of the county (or of Budapest) where you live. Contact details: www.kormanyhivatalok.hu.
A conciliation board: in a consumer dispute, after first trying to settle it with us, you can turn to the conciliation board of your place of residence or stay, or to the one you name in your application. The procedure is free for consumers. We cooperate in conciliation board proceedings but have not made a general declaration of submission. The boards for the studio and for our registered office:

Other conciliation boards: www.bekeltetes.hu.
Courts: you can also take a dispute to the competent court under the Civil Code and the Code of Civil Procedure.
16. Changes to these Terms
We may change these Terms; we publish changes on the website before they take effect and email guests with an account about significant changes. Changes do not affect contracts already made unless you expressly agree.
